THE TOOL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, CURRENTNESS, OR REGULATORY COMPLIANCE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER, ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF BUSINESS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO THE TOOL OR YOUR USE OF OR RELIANCE ON IT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE DEVELOPER AND RELATED PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE TOOL SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO ACCESS OR USE THE TOOL.

Assumption of Risk

You acknowledge that all treatment decisions, applications, calculations, and compliance determinations are made at your own risk and under your own control. You are solely responsible for verifying that your actions are lawful, label-compliant, safe, and appropriate for your circumstances.

Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the developer and its owners, officers, employees, affiliates, contractors, licensors, and agents from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  1. your use of the Tool;
  2. your reliance on any output or information from the Tool;
  3. your violation of applicable law, product labeling, or third-party rights; or
  4. any treatment decision, application, omission, or record created by you or on your behalf.

Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Tool or these Terms shall be brought exclusively in the state or federal courts located in Florida.

Changes to Terms

The developer may update these Terms from time to time. Your continued use of the Tool after updated Terms become effective constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Failure to enforce any provision of these Terms is not a waiver of that provision.
